As the owner of Windows7Forums.com and Windows8Forums.com, I would like to let you all know that I was attempting to purchase windowsforums.com and was defrauded by a seller known as Sean Spurr. Guess who has it now? Please see this email to the owner of SevenForums.com: John Fairbrother

I am the owner of Windows7Forums.com. I am aware of your work with SevenForums.com. Please be aware that I was attempting to purchase WindowsForums.com from its previous owner before he transferred it to you. A complaint was filed against him with the FBI/IC3 for violating ICANN UDRP rules. It is not surprising to see he made this move, but I am surprised who the buyer was. This was extremely unscrupulous. I need to inform you that publicdomainregistry.com was supposed to lock the domain once they received word from ICANN regarding an arbitration dispute under UDRP. He listed his site on BuyDomains.com and I bought it with the "Buy It Now" option at the list price of $6995.00. You need to know this because I was defrauded by this man and there is a criminal complaint against him with IC3 and the FBI. This message is not to intimidate you or incite you, but it is to give you clear, concise due diligence. I cannot imagine anyone better having the domain due to the good work of sevenforums.com. However, the events leading up to you acquiring it are completely unethical. If you had knowledge in advance of what was going on, this would implicate you. Basically, I am trying to seize the domain I purchased through BuyItNow.com/Afternic and have been doing so since this happened. Around July 16-17, days after the purchase an auth codes were sent, he violated a written contract and re-privatized the domain and domain locked it. Shortly thereafter it looks like he transferred it to you. I have documents proving Sean Spurr sold the domain to me. This is a major problem.


Please be aware that this information has been relayed to multiple third parties to clarify, since $6995.00 has still not been refunded, and the domain sale was a scam perpetrated by the owner Sean Spurr at the time. It has been CC'd to the escrow agent at Namemedia, the domain salesman/client manager Mike Warburton, Alexandra R from the National Arbitration Forum, and your registrar for ICANN UDRP compliance, and my administrative team.


If you're wondering why you are a Microsoft MVP and you have been banned, that says it all. Legally, we purchased the domain, I believe somehow he found out, and compromised the seller.
 
You are not the only one this has happened to. I got banned for life from Seven Forums last October 2011,for doing absolutely nothing wrong. And not only did they ban me,but they deleted all of my posts as if I was never there. And every time I log into Seven Forums I get this horrible ban message.

Seven Forums-
You have been banned for the following reason:
Persona non grata.
Date the ban will be lifted: never.

That's what you call being very nasty.

And I just read a thread on Techspot Forums about a well known member who has made many helpful tutorials on Seven Forums. And he is very upset because he too has been banned for life for no reason.

And many other people have been banned from Seven Forums when they should not have been banned.

What does being an MS MVP have to do with it? You say it says it all, but I don't see any relationship. How does that compromise the seller? Even if that's all true, why does the co-Admin at SF (and VF and EF) and essentially second-in-command so to speak, Shawn Brink - an MVP, still remain there unbanned when the value of doing this to anyone else or everyone else (whatever that may be) seems destroyed by that? And there are other MVPs remaining "over there" who are here not to mention others that may not be here though I didn't confirm that (but I should add I checked in VF - and Z3 tends to ban from all if banned from one so I thought that would suffice).

And to be honest, I don't even see the value or rationale in doing it unless Microsoft decided to get involved (which I doubt) and even then would expect the consequences to be an inability to use participation there for renewals or new approvals or possibly notifying the MVPs that they needed to stop activity there - something I'd find quite bizarre to say the least. And even if that were the case, why only MS MVPs and not also MS MCCs as well or even anyone holding any form of Microsoft certification as well?

In short, while I'm willing to accept that there may have been some sale issues long ago (even if I don't understand what windowsforums.com has to do with sevenforums.com or why it would be necessary to buy the first to get to use the second). Furthermore, while under arbitration if that's the case, aren't there rules concerning public disclosure of such sensitive information (as in your post) until events are settled? And whether arbitration or legal action, doesn't this disclosure harm your case and potentially subject you to a variety of legal actions in addition to possibly harming the case?

Also, some recently banned were not MS MVPs or MS MCCs - so what would this have to do with them and why would they be involved?

I at least would appreciate some clarification on how this relates to all of this. And yes, I did read your post in the link in Andrea's post, and that helped explain some of the differences and how owners interpret things, but didn't really explain this situation except that there seems to be more to it all than the letter you posted in this forum.

Well from reading the many posts on the web from other members who have been banned from Seven Forums for no real reason. And also many members I know from Windows 7 Forums and other forums have been banned from Seven Forums. It is obvious that Seven Forums are very strict and very selective about who they have as members.

Seven Forums also have Eight Forums and Vista Forums which are part of Seven Forums. So the message should be clear. Seven Forums are very strict and stricter than most other forums. Anybody they don't like, or anyone that does not tow the line, is out of there,banned from the forum. That is the way they are. Andrea Borman.

Andrea, I believe you misunderstood I was replying to Mike Fara, not to you. His issues are different than those you mention. I think your different concerns are clear to many if not all here if they already weren't before this happened, but this recent action was more extreme than most.

Well Mike said he was trying to buy Windows Forums.I have never heard of that site.

I don't believe that the actions are related to being a Microsoft MVP. Sean Spurr is in the U.K. as is John Fairbrother. He describes himself on his website as SEO Demiurge, Independent website publisher (LinkedIn: http://www.linkedin.com/pub/sean-spurr/7/582/586).

Based on the complaint filed against the WindowsForums.com site for violating ICANN UDRP rules that Mike posted, I expect that all search results for the former .com site have been purged from search results.

Well from what I saw on Google there is no Windows Forums.com there is only a Windows Forums.org. So they could have changed their web address.

But Brink who is the admin of Seven Forums,his real name is Sean and he is not in England he is in America. I found his profile here on Seven Forums-here-http://www.sevenforums.com/member.php?u=47

Sean, who goes by the user name of Brink, is the admin of Seven Forums,and their two sister sites,Vista Forums and Eight Forums. But I don't know if or not he is the owner of the sites. Andrea Borman.

Andrea, it isn't possible to merely "change the website address" unless you own the domain. I'm sure Mike Fara can explain better, but with an ICANN UDRP violation, the search engines would have been instructed to purge all search results for the offending site.

Well when I typed in the web address www.windows forums.com,I got nothing. There is no website by that address.

And what is an ICANN UDRP violation? What does ICANN UDRP stand for? Andrea Borman.

And also note if you directly input the URL www.windowsforums.com in your browser (you're getting no hits with what you used because of the space between windows and forum in your entry - that won't work) you will get the same as a search. What's interesting, aside from no specific listing for www.windowsforums.com (for reasons Corrine explained) if you search for that, is what does come up - especially as the first few entries. I imagine that may be part of the ongoing hoopla between Mike and Sean.

RE: sevenforums.com : http://who.godaddy.com/whois.aspx?domain=sevenforums.com&prog_id=GoDaddy. Note true ownership info is hidden by use of domainsbyproxy.com. Even without the proxy blocks (or even if they were there), how Z3 has ownership of sevenforums (or the others) defined is unknown (in fact, it is difficult to even prove his ownership though everyone pretty much knows it to be the case) and truly not pertinent to this since it is virtually certain that he is the one who makes these decisions regardless of how ownership is structured. There is a big difference between being the named registrar and listed owner there and how the company is legally structured (sole proprietor, divided ownership interests through partnerships or various types of corporations). One is for registration (and may not even be a real name {surely nobody thinks my name really is Kosh Vorlon or that either the avatar or profile picture are me} - the other is sort of what really counts in legal terms.

Brink is Shawn - not Sean - and this is a totally different person than Sean Spurr. His ownership interest or involvement in this is completely unknown and not really relevant. Being an Admin does not make you an owner.

This whole debacle is shocking and the bans would imo be to avoid a revolt from the membership, mainly by purging the most likely people who would raise a objection to the other things that have been going, on and in doing so disclose the underhand nature of the dealings mentioned in the previous posts, since those people banned live by a code of honour and behaviour that would never stand behind any dishonesty.The outright and blatant flouting of rules and regulations are just breath taking

Well another famous person, the actor Sean Connery, pronounced "Shawn" his name is spelt as Sean. So there are two ways of spelling it.

I do own windowsforum.com and not windowsforums.com. Our goal was to acquire both around the same time. We succeeded using escrow.com on windowsforum.com but something happened with our seller, Sean Spurr and windowsforums (PLURAL) dot com. He claimed he had to cancel the sale even though a Buy It Now sale was final and subject to ICANN UDRP rules. A refund to my credit card is still pending from NameMedia/BuyDomains. The owner of windowsforums.com (PLURAL) tried to conceal his identity using domain by proxy. When publicdomainregistry.com received information from the National Arbitration Forum and/or IC3 (criminal fraud investigation unit run by the FBI), they should have domain locked immediately and prevented Sean from transferring it to John Fairbrother. Basically, we were swindled. We had planned to merge our sites into one site... you can guess what it would have been called.

The funds left our escrow account on July 20, 2012 and were credited back to your credit card. You will need to contact your credit card company to see when the funds will show on your statement, but from previous dealings with credit card companies and refunds it appears that it takes them around 7-10 business days to show the incoming credit on your card statement, even though we processed it on July 20, 2012.

In regards to any documentation, I have forwarded all of your requests to our legal team and after consulting outside counsel they have told me, they cannot release any details except the seller contact information without a court ordered subpoena.

Sean Spurr is not to be confused with "Shawn Brink"

If we find John Fairbrother (owner of designermedia, and through that sevenforums and eightforums.com; aka z3r010) had malice aforthought and took possession of the domain in question when it should have been domain locked under ICANN rules, we have a very clear problem. The seller was not allowed to simply cancel a purchase through NameMedia/BuyDomains when the Buy It Now option is used (think eBay). We have the purchase records, we were sent auth codes, and he may or may not have interrupted the transfer process by offering more money. It is quite disgusting if you ask me and some nutty behavior.
